Very early into this debacle, I mentioned about making the bank show the note, and mentioned it a number of times since. I mentioned it before I heard of anyone else mentioning it, and was glad when I began to hear others mentioning it, not many people seemed to be listening, despite everything they owned being dumped in a heap on the curb and the locks changed on their homes.
U.S. Bankruptcy Judge Robert E. Grossman in Central Islip, New York, in a decision he said he knew would have a “significant impact,” wrote that the membership rules of the company’s Mortgage Electronic Registration Systems, or MERS, don’t make it an agent of the banks that own the mortgages.

“MERS’s theory that it can act as a ‘common agent’ for undisclosed principals is not supported by the law,” Grossman wrote in a Feb. 10 opinion. “MERS did not have authority, as ‘nominee’ or agent, to assign the mortgage absent a showing that it was given specific written directions by its principal.”

Merscorp was created in 1995 to improve servicing after county offices couldn’t deal with the flood of mortgage transfers, Karmela Lejarde, a spokeswoman for MERS, said in an interview last year. The company tracks servicing rights and ownership interests in mortgage loans on its electronic registry, allowing banks to buy and sell the loans without having to record the transfer with the county. It played a major role in Wall Street’s ability to quickly bundle mortgages together in securitized trusts.
I mentioned it other places beside cyberspace. People stared at me as though they were vexed cows looking at a cartoon animation running around their pasture.

A jerk would cop an attitude about this sort of thing, begin to feel people were stupid cows and stupid cows are for milking and for herding and for slaughter.

making headlines across the globe

I so don't want to bother cleaning up another Salon post, but, as you must know already, the DoJ has subpoenaed Twitter for all their records on Julian Assange, Jacob Appelbaum, Birgitta Jónsdóttir, Rop Gonggrijp and Bradley Manning. It started out being a sealed order [here], but Twitter fought the confidentiality of it so they could notify their account holders of the subpoena, and won [here]. Here is the statute under which the subpoena was made.

As discussed relative to the Daley appointment, "the absolute stranglehold large-scale corporate interests exert over virtually all realms of government policy", the capture of our entire government by the very people who have caused and profit from the activities WikiLeaks exposes is complete. Here, clearly, is proof, if you yet needed any, they, not we, own the DoJ.

A snippet from Glenn's piece runs:
...all of this extraordinary probing and "criminal" investigating is stemming from WikiLeaks' doing nothing more than publishing classified information showing what the U.S. Government is doing: something investigative journalists, by definition, do all the time.

And the key question now is this: did other Internet and social network companies (Google, Facebook, etc.) receive similar Orders and then quietly comply? It's difficult to imagine why the DOJ would want information only from Twitter; if anything, given the limited information it has about users, Twitter would seem one of the least fruitful avenues to pursue. But if other companies did receive and quietly comply with these orders, it will be a long time before we know, if we ever do, given the prohibition in these orders on disclosing even its existence to anyone.
Indeed, Julian Assange has the same concern, and Glenn will have more on all this tomorrow..

I'm hoping he doesn't stick merely to bellyaching about this, but begins exhorting his fellow prominent proponents of the rule of law to DO SOMETHING dispositive about our government's CRIMINAL activity.

There are other concerns that need addressing:
Marc Rotenberg, president of the online watchdog the Electronic Privacy Information Centre (EPIC) in Washington, said it appeared the US justice department was looking at building a case against WikiLeaks and its founder, Julian Assange, over its publication of secret US documents.

EPIC has already requested that the US authorities hand over information about their investigations into people who have donated to WikiLeaks via Mastercard, Visa or PayPal.

"The government has the right to get information, but that has to be done in a lawful way. Is there a lawful prosecution that could be brought against WikiLeaks? It seems unlikely to me. But it's a huge question here in the US," said Rotenberg.
This HAS TO BE stopped. We can't stump for the impeachment of Obama because the people who would be doing the impeaching need to be impeached themselves. Snap out of it! WE HAVE TO STOP THEM.

But Dodd-Frank was neither an FDR-style, paradigm-shifting reform, nor a historic assault on free enterprise. What it was, ultimately, was a cop-out, a Band-Aid on a severed artery. If it marks the end of anything at all, it represents the end of the best opportunity we had to do something real about the criminal hijacking of America's financial-services industry. During the yearlong legislative battle that forged this bill, Congress took a long, hard look at the shape of the modern American economy — and then decided that it didn't have the stones to wipe out our country's one dependably thriving profit center: theft.

Dodd-Frank was never going to be a meaningful reform unless these two fateful Clinton-era laws — commercial banks gambling with taxpayer money, and unregulated derivatives being traded in the dark — were reversed. The story of how the last real shot at reining in Wall Street got routed tells you everything you need to know about how, and on whose behalf, our government works. It was Congress at its most cowardly, deceptive best, with both parties teaming up to subject reform to death by a thousand paper cuts — with the worst cuts coming, literally, in the final moments before the bill's passage.

What happened next was a prime example of the basic con of congressional politics. Throughout the debate over finance reform, Democrats had sold the public on the idea that it was the Republicans who were killing progressive initiatives. In reality, Republican and Democratic leaders were working together with industry insiders and deep-pocketed lobbyists to prevent rogue members like Merkley and Levin from effecting real change. In public, the parties stage a show of bitter bipartisan stalemate. But when the cameras are off, they fuck like crazed weasels in heat.

First, in what amounted to an open handout to the financial interests represented by Brown, insurers, mutual funds and trusts were exempted from the Merkley-Levin ban. Then, with the floodgates officially open, every financial company in America was granted a massive loophole – one that allowed them to skirt the ban on risky gambling by investing a designated percentage of their holdings in hedge funds and private-equity companies.

The common justification for this loophole, known as the de minimis exemption, was that banks need it to retain their "traditional businesses" and remain competitive against hedge funds. In other words, Congress must allow banks to act like hedge funds because otherwise they'd be unable to compete with hedge funds in the hedge-fund business. With the introduction of the de minimis exemption, Merkley-Levin went from being an absolute ban on federally insured banks engaging in high-risk speculation to a feeble, half-assed restriction that will be difficult, if not impossible, to enforce.

The driving force behind the exemption was not Scott Brown, but the Obama administration itself. By all accounts, Geithner lobbied hard on the issue.

Lincoln, who was never considered a particularly strong advocate of finance reform, had originally proposed her ban on derivatives – the most radical reform in the entire bill – during a re-election campaign in which she faced a stiff populist challenge from Bill Halter, the lieutenant governor of Arkansas. Rumors circulated in Washington that Democratic leaders were cynically holding off on gutting Lincoln's proposal until she got past Halter in the primary.

If that was the plan, it worked. In early June, only a week after she defeated Halter in the runoff, Lincoln set about gutting her own rule.

Note: I am so interested in things like remote viewing and what the space lizard researchers have to say about things because a very large number of what you call paranormal things have happened to me in my life. My teacher, at will, or at a tone, knows the moment something crucial dawns on me and calls me in that moment, from a great physical distance away. Completely unexplainable things have saved my life more than once. I can actually hear people thinking around me in moments of silent concentration, like while taking tests or meditating in the same room. I could go on and on.

I don't have this mountain of translations of the ancients around me for nothing. I have read almost all of them once, most of them twice, some of them six and five and four times, and I want to be reading them again. I want to calm my mind. I want to look at stuff beside the doings of the post turtle's torments. Genghis Yoo asked for it. He got it. He's not up to it.

I can't be the kind of help I want to be until I replenish my mind. The sorrow and anger will cause me to fail if I do not get my own kind of creativity and productivity back. I need to chill. So I'm listening to odd lectures. Trying to concentrate on who yanked me from that doorway, saying wrong sana, and why. It was so fast that I couldn't get the whole picture. I know it was a he. I know he grabbed my arm firmly and pulled me physically away from entering. I know he did it to protect me. But I don't know if he did it for me or Me. So I need to get back to my books.

I can't do my books when I want it so hugely. So I'm just dabbling and dipping in for a bit and then going off to pull weeds or watch a movie or listen to an interview or lecture... putter... let my muscles loosen... bat away thoughts that try to grab me... just generally get back my energy, stabilize it with virtue, and keep it. I haven't fallen all my ancients yet. It's my job.

So, really, I'm liable to be even more erratic than usual around here. I'm not tuning all the way out. I'm just getting my equanimity and using it for something beside a hat rack.

The Department of Defense announced today the deaths of three soldiers who were supporting Operation Enduring Freedom. They died Feb. 3 in Timagara, Pakistan, from wounds suffered when insurgents attacked their unit with an improvised explosive device.

Killed were:

Sgt. 1st Class David J. Hartman, 27, of Okinawa, Japan.

He was assigned to the 96th Civil Affairs Battalion (Airborne), 95th
Civil Affairs Brigade (Airborne), Fort Bragg, N.C.

Sgt. 1st Class Matthew S. Sluss-Tiller, 35, of Callettsburg, Ky.

First it's the Holocaust Industry messing up someone they perceive as an impediment, and now it's carbon tax pansies fucking with our ability to do anything about a global emergency. I'm sorry. No matter what is causing it, a global effort to clean up and do whatever we can to mitigate the damages, can ONLY be good for our planet, and even if that means risking the global plutocracy getting more money out of us, IT HAS TO BE DONE, even if it doesn't work! You fuckers! You pigs! It's real! And we can't stand idly by, not do whatever we possibly can, including pay, when there's even a remote possibility it might help.

WHAT is wrong with this picture?

on the question of fudd's hit squad

Flo is wanting to revive this line of inquiry, and so am I. I was going to copy out the source code for Fetzer's piece on the matter from an extremely irritating site, but this guy beat me to it. Funny how it's always Fetzer with the moxie to come out with work on the heinous crimes of our government... but I suppose it would follow from everything he's learned in his years of scholarship in the matter of JFK's assassination. I think he screwed up in a big way on the 9/11 stuff, but not in his determination to get something more closely approximating actuality than the witless fairy-tale that has permeated our entire society. So maybe you want to scan what he has to say about Fudd's killings.

Tarpley once postulated that the perpetrators of 9/11 weren't anyone in the White House, but that Fudd would have been taking the orders and executing them, rather than *, who was just a blithering figurehead, but that all of them were merely doing as they were told. You'll pardon me if this theory of his is making even more sense to me now, and if I believe there is no reason on earth to think the hit squad is out of business....
